Co-habitation Agreements
As more couples choose to live together without the formality of marriage, the implications
on practical arrangements are often left unchecked. The law treats co-habitees differently
to married couples so it is prudent for couples living together to have an agreement
in place which sets out what should happen should the relationship break down. This
is a Co-habitation Agreement.
What Are Co-habitation Agreements?
A co-habitation agreement is like a pre-nuptial agreement for unmarried couples.
It can provide for such matters in the event of a relationship breakdown as:
- the financial obligations of either party
- distribution of assets owned before the co-habitation and ones acquired during
it
- liability for debts
Are they Enforceable?
Whilst the agreements are not strictly enforceable, they are increasingly seen as
persuasive in the event of separation. Even if a couple has an entirely justified
trust in each other, this type of agreement could help avoid lengthy disputes when
relations break down.
