Pre-nuptial Agreements

You may be mistaken in thinking that a pre-nuptial agreement is only necessary where one of the parties has significant assets they want to protect. In practice, this type of agreement is widely used, and though untested in our courts, is becoming increasingly persuasive when relations break down.

What Are Pre-nuptial Agreements?
A pre-nuptial agreement sets out the wishes for the division of assets if the relationship breaks down at a later date. Just as making a Will is accepted as common sense, so could a pre-nuptial agreement be considered part of your personal planning.

Are They Enforceable?
Whilst the pre-nuptial agreement is not strictly enforceable, there have been several decisions in the courts where the existence of one has led to a reduction in the financial settlement to bring it more in line with the agreement.
