Grievance procedures

There are times when difficulties arise with employees and action has to be taken. Whether the employer or employee wishes to complain, a professionally drafted grievance procedure can save time and, if followed correctly, can be crucial in defending any subsequent legal proceedings by the employee.

A grievance procedure can cover disputes including: terms of employment, pay, working conditions, problems with co-workers, discrimination and failure to comply with statutory employment rights.

It should include a number of set steps to be followed, known as the “statutory minimum procedure”, before any other action is taken, such as an employment tribunal. Any failure to follow it, aside from the employee fearing they will suffer harassment or violence if they do, could result in a reduced award if they subsequently make a claim.
