Fixed Fee Divorce

By Connie Shelley

Looking to start your divorce and feeling overwhelmed? Speak to our Family Team to put your mind at ease and let us deal with the process for you from start to finish. At Everys, we offer a fixed fee divorce for £500 plus VAT (excluding any disbursements) which includes advice and updates at every stage.

What does a fixed fee divorce mean and what does this include?

In April 2022, new legislation was created to completely change the process and introduce a no-fault divorce. You no longer need to give a specific reason for the divorce – it’s enough to state that the marriage has irretrievably broken down.

This has enabled Everys to offer a fixed fee divorce, keeping costs low whilst taking the worry and stress away from you.

The fixed fee will cover all your legal fees in relation to the divorce only. This does not include any work or advice given to you in relation to the financial aspect of your divorce or in relation to any children matters.

The fixed fee will remain in place unless the divorce becomes contested at which point, we will advise you as to the next steps in moving towards an hourly rate. Since the change in the law, the divorce can only be contested based on jurisdiction, not simply because one party does not agree to a divorce.

The fixed fee divorce includes the following: –

  • an initial letter setting out the divorce process;
  • applying for the divorce;
  • applying for conditional order; and
  • applying for final order.

Any additional advice needed will be charged by hourly rate and may take you out of the fixed fee.

Disbursements such as court fees, process servers and counsel’s fees are not included within the fixed fee.

We cannot offer the fixed fee to any clients where there may be issues with regard to jurisdiction.

What are disbursements?

Disbursements are external fees. They are payments that need to be made to a third party by your solicitor and are therefore separate fees that need to be paid in advance.

In a typical divorce, the disbursements would be a £612 court fee.  We can advise you as to whether you may be entitled to any fee remissions for this cost.
